These Terms of Service ("Agreement") are a legally binding agreement between the user or subscriber of the Services ("User" or "you") and Ginylil, a company based in Spain, with its principal place of business at Estepona ("Ginylil," "we," or "us"). By registering for the Services or by accessing or using the Services or Website, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. If you are entering into this Agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this Agreement, in which case the terms "User," "you," or "your" shall refer to such entity. If you do not have such authority, or if you do not agree with the terms of this Agreement, you must not accept this Agreement and may not use the Services. You acknowledge that this Agreement is a contract between you and Ginylil, even though it is electronic and is not physically signed by you, and it governs your use of the Services.

PLEASE READ THESE TERMS OF SERVICE CAREFULLY. IF YOU DO NOT AGREE WITH THESE TERMS, YOU MAY NOT REGISTER FOR OR USE THE SERVICES.

1. SERVICES

1.1 Definition

The "Services" consist of a platform to create personalized blessings with customizable titles, messages, music, backgrounds, and images. Users can generate blessings hosted on a unique URL for sharing. Note: The URLs for generated blessings will remain active for approximately three (3) days before being automatically removed.

1.2 Visibility and Use of Published URLs

All blessings created on the platform are hosted on public URLs that are visible to anyone with access to the link. By generating a blessing, you acknowledge that the content, including any uploaded images, may be accessed, downloaded, or misused by third parties. Ginylil is not responsible for any unauthorized use, distribution, or theft of your content by others.

1.3 Restrictions on Content

Users are strictly prohibited from publishing content (text, images, music, or other media) that:

Is harmful, offensive, discriminatory, abusive, defamatory, sexually explicit, or otherwise inappropriate.
Violates intellectual property rights, such as uploading copyrighted images or music without the necessary permissions.
Violates local, national, or international laws or regulations.

Ginylil reserves the right to remove any content deemed inappropriate, without prior notice, and to suspend or terminate accounts violating these policies.

1.4 User Acknowledgement of Responsibility

By using the Services, you acknowledge that you are solely responsible for any content you upload or create, including ensuring that it complies with these Terms and applicable laws. Ginylil assumes no responsibility for monitoring user-generated content but reserves the right to review and act upon any reports of violations.

1.5 Future Paid Subscriptions

Ginylil reserves the right to introduce subscription plans in the future. These paid plans will provide additional features and services to subscribed users. Details about these plans, including pricing and terms, will be shared prior to their implementation.

1.6 Updates; Additional Services

The Services include all updates, modifications, and enhancements that Ginylil elects to make generally available to its users at no additional charge ("Updates"). All Updates are subject to the terms of this Agreement. Additional products and services may be subscribed to separately, subject to additional terms and conditions.

1.7 Third-Party Sites, Services, and Products

The Services and Website may refer or link to third-party sites, products, or services. These are provided for your convenience and are not under our control. We are not responsible for the content or actions of any third-party sites and do not warrant, endorse, or assume responsibility for them. Your use of these third-party services may be subject to additional third-party terms of service and privacy policies.

2. USER RESPONSIBILITIES

2.1 Content Ownership and Accountability

You retain ownership of the content you create but are solely responsible for ensuring it complies with these Terms. By publishing content on the platform, you grant Ginylil the right to host and display it temporarily for the duration of the URL's availability.

2.2 User Content Review and Reporting

While Ginylil does not actively monitor all user-generated content, we reserve the right to:

Review and remove content that violates these Terms or is reported by others.
Suspend or terminate user accounts in cases of repeated violations.

2.3 Prohibited Activities

Users may not:

Post content that violates any applicable laws or regulations.
Share content that infringes on intellectual property rights.
Publish any material that could harm, offend, or mislead others.
Upload any copyrighted content without permission.

Ginylil reserves the right to remove or modify content that violates these terms without prior notice.

3. REGISTRATION AND ACCOUNT

3.1 Registration

To use the Services, you must create a user account. Each User Account is intended for individual use.

3.2 User Responsibilities

You are responsible for maintaining accurate account information, securing your account credentials, and complying with the terms of this Agreement.

4. FEES AND FUTURE PAYMENT

4.1 Support Our Work

Users have the option to support our work by contributing €3 through the "Support our work" link. These contributions are voluntary and non-refundable. They do not constitute a purchase of goods or services and are not tax-deductible. Contributions are used solely to support the operations and development of this website. By contributing, users confirm that they are legally authorized to make the payment. Ginylil reserves the right to modify the suggested contribution amount or the terms of the "Support our work" link at any time without prior notice.

4.2 Future Paid Features

Ginylil reserves the right to introduce subscription plans or paid features in the future. These will include additional features and services to subscribed users. Details about these plans, including pricing and terms, will be shared prior to their implementation.

5. TERMINATION

5.1 Termination by Ginylil

Ginylil reserves the right to terminate your account or restrict access to the Services if you violate these terms. Upon termination, URLs of blessings you created may also be removed earlier than the stated period.

5.2 User Termination

Users may terminate their accounts at any time by submitting a written request to support@ginylil.com. Upon receiving the request, Ginylil will process the termination and delete the user’s account and associated content, including any active blessings or uploaded data, within a reasonable time frame. Please note that some information may be retained as required by law or for legitimate business purposes.

6. WARRANTY DISCLAIMER & LIMITATION OF LIABILITY

6.1 Disclaimer

The Services are provided "as-is" without warranties of any kind.

6.2 Limitation of Liability

Ginylil shall not be liable for:

Any indirect, incidental, special, consequential, or punitive damages.
User actions or content uploaded to the platform.

Ginylil's total liability shall not exceed the amount you have paid, if any, under this Agreement in the past three months.

7. INDEMNITY

You agree to indemnify and hold Ginylil harmless from any claims, damages, or liabilities arising out of your use of the Services, including but not limited to:

Violations of these Terms.
Infringement of intellectual property rights.
Non-compliance with applicable laws or regulations.

8. GENERAL PROVISIONS

8.1 Governing Law

This Agreement is governed by the laws of Spain, without regard to conflict of law principles.

8.2 Changes

Ginylil reserves the right to update these Terms at any time. Changes will be effective upon posting on the Website, and continued use of the Services constitutes acceptance of the revised Terms.

8.3 Severability

If any provision of this Agreement is found to be unenforceable, the remaining provisions will remain in effect.
